2020 Fishers Foods “Customer Appreciation Week” Sweepstakes

 

Official Rules

 

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

 

SWEEPSTAKES PERIOD: The 2020 Fishers Foods Marketing Inc. “Customer Appreciation Week” Sweepstakes (the “Sweepstakes”) starts at 8:00:00 AM Eastern Time on Wednesday, October 7, 2020 and ends at 9:00:00 PM Eastern Time on Tuesday, October 13, 2020.

 

ELIGIBILITY: The Sweepstakes is open to legal residents of the fifty (50) United States, 18 years of age or older, who are registered members of the Fishers Rewards program. Fishers Rewards registration and membership are free. To join Fishers Rewards, you can sign up at any Fishers Foods location or visit https://www.fishersfoods.com/my-account#!/create.  Employees, directors, and officers of Fishers Foods, its affiliates, subsidiaries, and advertising/promotion agencies, and the immediate families (spouse, parent, child, sibling, grandparent, and spouse and "step" of each), and members of the same household of each such person (whether or not

related) are not eligible to enter or win. The Sweepstakes is void where prohibited by law.

 

HOW TO ENTER: There are three (3) ways to enter the Sweepstakes as follows:

 

(1) Make a designated purchase (details below) at any Fishers Foods store location and provide your Rewards card or telephone number linked to your Fishers Rewards account to receive (1) one entry per qualifying purchase into the random drawings.

 

OR

(2) Make a designated purchase (details below) online with Fishers to Go Curbside Pick Up and provide your Rewards card or telephone number linked to your Fishers Rewards account to receive (1) one entry per qualifying purchase into the random drawings.

OR

(3) TO PARTICIPATE WITHOUT MAKING A PURCHASE, you may fill out an entry form in the store, available from Customer Service.

 

Qualifying purchases for each contest:

TVs:

Earn one (1) entry for any meat purchase. Includes any Meat Sale Items, Beyond Meat or Gardien Products. One (1) entry per Rewards account.

 

Pepsi-branded bike with helmet:

Earn one (1) entry for any Pepsi, Lipton or Ban product purchased. One (1) entry per Rewards account.

 

Turkey Hill ice cream (win your height in ice cream):

Earn one (1) entry for any Turkey Hill Ice Cream 48oz purchase. One (1) entry per Rewards account.

Essentia branded golf bag:

Earn one (1) entry for any Essentia Purified Alkaline 9.5PH Water product purchased. One (1) entry per Rewards account.

 

Callaway Core Power Golf Bag:

Earn one (1) entry for any Coke, Core Hydration or AHA product purchased. One (1) entry per Rewards account.

 

5 lb Hershey’s Candy Bar:

Earn one (1) entry for any any Hershey’s, Reese’s, Kit-Kat, Pay Day or Almond Joy product purchased. One (1) entry per Rewards account.

 

Any requests for entries which are made in any fashion other than as specified herein are void.

 

RANDOM SWEEPSTAKES DRAWING & WINNER NOTIFICATION: Potential winners will be determined via random drawing on or about October 19, 2020. All decisions made will be final in all matters relating to this sweepstakes. Odds of winning are determined by total eligible entries received from both methods of entry combined. Potential winners will be notified by email or phone number. If a potential winner does not respond within two business days, or prize notification is received as undeliverable, prize will be forfeited. Potential winners may be required to furnish proof of age (for example, a driver’s license or passport). All prizes that are properly claimed will be awarded. Fishers Foods shall have no liability for a potential winner’s failure to receive notices due to the winner’s spam, junk, security or other email filtering system or for a potential winner’s provision of incorrect or otherwise non-functioning contact information. If a winner cannot be contacted, is ineligible, or fails to claim the prize within indicated time period, prize may be forfeited. Fishers Foods is not responsible for technical difficulties, email or phone service disruptions, or other equipment or service issues which might affect the ability of Fishers Foods to notify a winner.

 

PRIZES AND APPROXIMATE RETAIL VALUES (ARV): Fifteen (15) Prizes: Four (4) 50-Inch Smart Televisions (1 per location, One (1) Pepsi Bike with Helmet, Four (4) Turkey Hill Win Your Height (number of ice cream containers depends on height of winner), One (1) Essentia Golf Bag, One (1) Callaway Core Power Golf Bag, Four (4) World’s Largest Hershey’s Bar 5 lb. (1 per location). Total ARV of all prizes: $3,000.00. Prizes will be fulfilled approximately 2-3 weeks after winner verification. Prizes will be held at Fishers Foods’ customer service counter. Gift Cards are subject to certain terms and conditions as specified by Fishers Foods. Winner is responsible for any federal, state, and city taxes.

 

There is a limit of one (1) prize per person/family/household/address. Acceptance of prize constitutes winner’s permission for Fishers Foods and its designees  to use their names, voices and statements relating to the Sweepstakes or Fishers Foods, and photographs or other likenesses, without further compensation, notification or permissions in any publicity or advertising carried out by Fishers Foods or the Released Parties (as defined below) in any and all media now known or hereafter developed without territorial or time limitation, except as prohibited by law.

 

Fishers Foods is not responsible for misdirected prizes, lost, late, illegible, incomplete, invalid, unintelligible, misdirected, technically corrupted or garbled entries, or for incomplete Fishers Rewards profiles, or for problems of any kind, whether mechanical, human or electronic, all of which result in disqualification of entry. Neither Fishers Foods nor any of the Released Parties shall be held responsible for delays in awarding prizes for any reason outside of their control. Prizes will only be awarded to verified winners. Proof of submission will not be deemed proof of receipt by Fishers Foods.

 

GENERAL CONDITIONS: By entering the Sweepstakes, entrants fully and unconditionally agree to be bound by these Official Rules and the decisions of Fishers Foods, which will be final and binding in all matters relating to the Sweepstakes. By participating, entrant agrees to release, discharge and hold Fishers Foods and Administrator, and their respective parents, subsidiaries, affiliates, retailers and advertising and promotion agencies, and each of their respective employees, officers, directors, shareholders, representatives and agents, as well as the successors and assigns of any of the foregoing parties (collectively, the “Released Parties”), from any and all liability, loss, litigation, claim, or damage, including illness, injury, or death, that may occur, directly or indirectly, whether caused by negligence or not, from (i) participation in the Sweepstakes and/or acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware, or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Sweepstakes; (v) electronic or human error which may occur in the administration of the Sweepstakes or the processing of entries/text messages/postcards, regardless of cause. Fishers Foods makes no representation, warranty or guarantee of any kind regarding the prizes offered in the Sweepstakes.

You are not a prize winner until your eligibility has been verified, and it is determined that you have complied with all terms of these Official Rules.

 

Under no circumstances will more than the stated number of prizes set forth herein be awarded. Fishers Foods reserves the right, in its sole discretion, to modify or terminate this

Sweepstakes (or any portion thereof), should any technical failures, unauthorized human intervention or other causes corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes. Fishers Foods reserves the right, in its sole discretion, to disqualify any entrant from this Sweepstakes or any other promotion conducted now or in the future by Fishers Foods or any of its affiliates if an entrant’s fraud or misconduct affects the integrity of the Sweepstakes or is otherwise in violation of these Official Rules, as determined by Fishers Foods in its sole discretion. Any other form of entry not specified herein is prohibited. No automatic, programmed, robotic or similar means of entry are permitted. ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS

SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, FISHERS FOODS RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

 

By participating, entrant agrees that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of Fishers Foods in connection with the Sweepstakes, shall be governed by and construed in accordance with the laws of State of Ohio, without giving effect to any choice of law or conflict of law rules. By participating, entrants consent to the jurisdiction and venue of the federal, state and local courts located in Canton, Ohio. Any failure to enforce any term, condition or provision of these Official Rules shall not constitute a waiver of such term, condition or provision.

 

The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Fishers Foods’s employees are not authorized to waive, modify or amend any provision or provisions of these Official Rules in any manner whatsoever.
